URGENT - COURT RULES ALL PERSONS IN THE US - EVEN THOSE WHO ENTERED WITHOUT A VISA HAVE THE RIGHT TO A BOND HEARING
The district court in Maldonado Bautista granted nationwide class certification and partial summary judgment on behalf of the class rejecting an Immigration Court/Board of Immigration Appeals decision in Matter of Yajure Hurtado and the predecessor ICE policy applying detention without bond to all persons who entered without admission/inspection.
The Court's decision means that anyone detained in the USA by ICE has the right to a bond hearing for release on bond.
This is excellent news for the many persons who entered the USA without a visa, and were subject to immediate arrest and deportation. These immediate deportations will stop and almost all persons detained by ICE will have a hearing to be released on Bond.
